Nima Care Pty Ltd (ABN 90 651 231 622) is a registered NDIS provider. This policy explains what personal information we collect, why we collect it, how we keep it safe, and what you can do about it. It applies to participants, their families and carers, referrers, staff and anyone who contacts us.
We follow the Privacy Act 1988 (Cth) and the Australian Privacy Principles, the Health Records Act 2001 (Vic), the NDIS Act 2013 and the NDIS Practice Standards.
What we collect
We only collect what we need to support you. Depending on your situation this can include:
- Your name, date of birth, contact details and NDIS number.
- Information about your disability, health, and the supports you need.
- Your NDIS plan and the funding in it.
- Information about your housing, your family and carers, and other services involved in your life.
- Information about contact with police, courts or corrections, where it affects your support.
- Records of the support we provide, including progress notes and incident reports.
- Details of the people you have asked us to talk to, such as a family member, guardian, nominee or advocate.
Some of this is sensitive information. We collect it only with your consent, or where the law requires or allows us to.
How we collect it
Most information comes from you, or from someone you have asked to speak for you. We also receive information from referrers such as hospitals, housing services, corrections, legal services and the NDIA, and from other providers involved in your support. Where practical, we tell you what we have received.
If you use our website, we collect basic technical information such as your browser type and the pages you visit. We do not use this to identify you.
Why we collect it
- To provide support coordination and support work.
- To plan your supports and keep them working.
- To work with other services involved in your life, where you have agreed.
- To claim payment from the NDIA or your plan manager.
- To meet our obligations to the NDIS Quality and Safeguards Commission, including reporting incidents.
- To keep you and our staff safe.
- To improve our services.
Who we share it with
We share your information only when we need to, and only with people who need it. That can include:
- The NDIA, your plan manager and the NDIS Commission.
- Health services, housing services and other providers involved in your support, with your consent.
- Your family, carer, guardian, nominee or advocate, where you have asked us to.
- Police, courts or corrections, where the law requires it or where there is a serious risk to someone’s safety.
- Our staff and contractors, who are bound by confidentiality.
- Our software providers, who store data on our behalf.
We do not sell your information. We do not send it overseas unless a software provider stores it on servers outside Australia, in which case we take reasonable steps to protect it.
Your consent
When you start with us we ask for your consent to collect and share your information, and we explain what that means in plain language. You can change or withdraw your consent at any time by telling your coordinator or contacting us. If you withdraw consent, some supports may become harder to provide, and we will explain what that means for you.
How we keep it safe
We store records in secure, password-protected systems. Paper records are kept locked. Only staff who need your information to do their job can see it. All staff sign a confidentiality agreement and complete privacy training.
We keep records for at least seven years after we stop supporting you, as the NDIS rules require. After that, records are securely destroyed.
Seeing and correcting your information
You can ask to see the information we hold about you. You can ask us to correct anything that is wrong or out of date. Contact us using the details below. We will respond within 30 days. There is no charge.
If something goes wrong
If we become aware of a data breach that is likely to cause you serious harm, we will tell you and the Office of the Australian Information Commissioner as soon as practicable, and explain what we are doing about it.
